is there a way to play without a patch? like install diablo 2 and not install the 1.09 patch?

You can play single player without it..but not b.net..

When you log onto Battle.net it automatically updates your game version, if they didn't do this people would only play .08 sometimes to get awesome stuff like .08 Arkaines etc.
